Taking Action: The Federal Crown
The Minister of the Environment, Conservation and Parks has been in touch with the federal MOE since Jerry’s yeasty catastrophe became national news. The feds have expressed interest in bringing action against InBev under SARA, among other protections. Their tone is tentative, however, and they have stated that they wish to corroborate their jurisdictional role with the Province before proceeding.
Reflect on the Crown’s concerns and advise the Province. How does the dual-aspect doctrine (i.e. in Crown-Zellerbach) come to bear on these issues? Is action under SARA warranted?
